The court’s ruling recognised surrogacy as a protected medical procedure, affirming intended parents as the legal guardians of surrogate-born children. Most Mexican states permit international, same-sex, single, and heterosexual couples to engage in surrogacy arrangements. However, implementation of the court’s decision varies across states, prompting caution. Similar to Colombia, Mexican surrogates must have prior successful pregnancies and pass psychological and physical evaluations. While the legal landscape is evolving, navigating surrogacy in Mexico requires careful consideration due to discrepancies in enforcement across states. The cost of a standard surrogacy programme in Mexico typically amounts to around USD $70,000, covering clinic fees; surrogate compensation; legal expenses; and surrogate care. Post birth Mexican documents can take some time to be processed, approximately 3-4 months, with at least one intended parent required to be a citizen of the destination country.
