Argentina occupies a unique legal space for surrogacy. Although surrogacy is not explicitly regulated, it’s also not prohibited. The national Constitution (Articles 16 and 19) allows private actions as long as they don’t harm others. Argentine courts, especially in Buenos Aires (CABA), have recognized surrogacy, with surrogacy-related births becoming increasingly common.
Buenos Aires has advanced Assisted Reproductive Technology (ART), including “Solidary Gestation.” This form of surrogacy involves a surrogate carrying a pregnancy for intended parents without any biological or legal connection to the child.
In Buenos Aires, Disposition Nº 93/DGRC/17 supports surrogacy. Children born via Solidary Gestation can be registered without a judicial trial, provided the following conditions are met:
This law applies to everyone—single individuals (including single women), couples, and same-sex partners. There are no residency or citizenship requirements. Only the legal parents are listed on the birth certificate, based on the Procreation Will.
Certain requirements apply to the surrogacy programme:
Gestational carrier: if a medical condition prevents the intended parent(s) from carrying the pregnancy, a gestational carrier is an option. Common reasons include: uterus absence (from birth or surgery), significant uterine anomalies (like Asherman syndrome or a unicornuate uterus). Health conditions making pregnancy dangerous (e.g., pulmonary hypertension) or biological limitations for single men or male couples.
Age requirement: you or your partner must be under 51 years of age when entering the programme.
Sperm Provider: if you’re using your own sperm, you’ll need a recent semen analysis and an infectious disease screening for HIV I/II, Hepatitis B/C, syphilis, gonorrhoea, and chlamydia.
Egg Provider: for those using their own eggs, you’ll need an AMH test and antral follicle count to assess ovarian reserve. Infectious disease screenings are also required.
When shipping embryos, they must be at the blastocyst stage and have PGT-A chromosomal testing to ensure they are chromosomally normal (euploid). A summary of infectious disease tests for both sperm and egg providers must also be included.
