In 2022, Argentina gained attention as a promising surrogacy destination. It welcomed singles, same-sex couples, single men, and both married and unmarried heterosexual couples. Its appeal stemmed from a legal framework in Buenos Aires that listed intended parents on the child’s birth certificate from the start, granting them full parental rights.
Between 2017 and July 2024, parentage transferred seamlessly without requiring a court order if specific criteria were met. However, in October 2024, a significant legal change occurred. A court ruling mandated that surrogates remain listed on the birth certificate as legal parents. This altered the previously straightforward process.
In addition, Argentine authorities increased scrutiny in 2024, launching investigations into clinics, law firms, and notaries. These actions, alongside arrests of local and foreign individuals, aimed to address concerns over potential commercialisation and exploitation in surrogacy arrangements.
As of 1 November 2024, most IVF clinics in Argentina have paused embryo transfers for surrogacy. The few clinics still operating have raised their prices significantly. The situation remains under review, with updates anticipated in early 2025. Intended parents already in the middle of their journeys can proceed, but many are now exploring alternatives.
